Witnessing Wills remains an essential part of having a valid Will. The rules, despite COVID, remain unchanged and even the most carefully prepared Will will fail if the Will signing and witnessing process has not been followed to the letter.
We now have a population where we are living longer but this means we are more likely to lose mental capacity or be vulnerable to fraud, undue influence or financial abuse.
We had a case where a home- made Will was witnessed by a beneficiary’s wife which meant that one of the deceased’s sons was disinherited.
